A permit must be issued prior to the installation of an in-ground, above-ground, permanent or fixed pool, as well as for a hot tub or whirlpool with a capacity of 2,000 liters or more. Installation must comply with municipal and provincial standards for residential pool safety.
Since August 9, 2023, it has been mandatory to install a water meter when installing an above-ground or in-ground pool. The owner must purchase the water meter and all accessories required for its installation at his or her own expense. The water meter must comply with the specifications detailed in Appendix F of the regulation 1116-2022.
Regulatory provisions for swimming pools and their accessories (Zoning by-lawart. 108)
The pool must comply with provincial standards safety.
♦ Not to be located under a power supply line.
♦ A distance of at least 1 m must be left clear between a safety fence.
♦ The power supply for a pool lighting source must be underground.
Pool access control
♦ All swimming pools must be equipped with a ladder or staircase for getting in and out of the water.
♦ Every swimming pool must be surrounded by an enclosure so as to protect access. The enclosure must:
- prevent the passage of a spherical object 10 cm in diameter
- be at least 1.2 m high
- be free of any fastener, projection or openwork that could facilitate climbing
Note: A wall forming part of an enclosure must not have any opening allowing access into the enclosure. - A hedge or shrubbery cannot form an enclosure
♦ Door in an enclosure:
- same characteristics as described for the speaker
- passive safety device installed on the inside of the enclosure, in the upper part of the door
- should close and lock automatically
♦ The speaker is not required in the following situations:
- above-ground pool with a wall height of at least 1.2 m above ground at all points
- demountable pool with a wall height of 1.4 m or more
- Access to the pool is gained in one of the following ways:
- Ladder equipped with a safety door that closes and locks automatically
- Ladder or platform with access protected by an enclosure
- Terrace attached to the residence opening onto the swimming pool and protected by an enclosure
Equipment and accessories
♦ All pool-related equipment must be installed more than 1 m from the wall or, as the case may be, the enclosure.
- The pipes connecting the appliance to the pool must be flexible and must not be installed in such a way as to facilitate access to the pool.
- A device may be located less than 1 m from the pool or enclosure if it is: inside an enclosure having the characteristics described above, under a structure that prevents access to the pool from the device, and if this structure is at least 1.2 m high and has no fasteners, projections or openwork that could facilitate climbing, or in a shed.

Regulatory provisions for swimming pools and their accessories on land occupied by the "residential" use group
Location
♦ Do not place the pool under Hydro-Québec overhead wires
♦ Check the conformity of your installation in relation to overhead power supply wires
♦ Other servitudes (right-of-way, road easements, etc.) may exist on your land. The surveyor's certificate of location is your reference document for finding this information.
♦ The construction or installation of an in-ground pool is authorized in a front or side yard ad-jacent to a street under the following conditions:
- the yard must be 30 m deep
- the pool must not be located in the part of the lot between the wall of the building and the street line, facing this wall
- a wooded strip at least 10 metres wide must separate the pool from the public thoroughfare.
