Residential Swimming Pool Safety Regulations

Residential Swimming Pool Safety Act

(chapter S-3.1.02, a. 1).

SECTION I

INTERPRETATION

1. In these regulations, unless the context indicates otherwise, the following terms shall have the same meaning:

1°  "swimming pool": a permanent or temporary outdoor artificial pool intended for bathing, with a water depth of 60 cm or more and not covered by the Regulation respecting safety in public baths (chapter B-1.1, r. 11), excluding a whirlpool bath or a hot tub when their capacity does not exceed 2,000 liters;
2°  "in-ground or semi-in-ground pool": a pool buried, in whole or in part, below the surface of the ground;
3°  "above-ground pool": a rigid-walled pool permanently installed on the surface of the ground;
4°  "demountable pool": a flexible-walled pool, inflatable or not, intended for temporary installation;
5°  "installation": a swimming pool and any equipment, construction, system or accessory intended to ensure its proper operation, to ensure the safety of persons or to provide or prevent access to the pool.

SECTION II

ACCESS CONTROL

2. All in-ground and semi-in-ground swimming pools must be equipped with a ladder or staircase for getting in and out of the water.

3. Subject to article 6, all swimming pools must be enclosed in such a way as to protect access.

4. An enclosure must:

1°  prevent the passage of a spherical object 10 cm in diameter;
2°  be at least 1.2 m high;
3°  be free of any fastener, projection or openwork that could facilitate climbing.
When the enclosure is formed by a chain-link fence, the links must have a maximum width of 30 mm. However, if slats are inserted in the mesh, their width may be greater than 30 mm, but they must not allow the passage of a spherical object over 30 mm in diameter.
A wall forming part of an enclosure must not be fitted with any opening allowing entry into the enclosure. However, such a wall may be fitted with a window if it is located at a minimum height of 3 m from the ground on the inside of the enclosure, or if its maximum opening does not allow the passage of a spherical object over 10 cm in diameter.
A hedge or shrubbery cannot constitute an enclosure.

5. Any door installed in an enclosure must have the features specified in article 4.

Any door referred to in the first paragraph must also be fitted with a passive safety device enabling it to close and lock automatically. This device can be installed either on the inside of the enclosure in the upper part of the door, or on the outside of the enclosure at a minimum height of 1.5 m from the floor.

6. An above-ground pool with a wall height of 1.2 m or more at any point above the ground, or a demountable pool with a wall height of 1.4 m or more, does not have to be enclosed when access to the pool is gained in either of the following ways:

1°  using a ladder with a safety door that closes and locks automatically to prevent use by children;
2°  by means of a ladder or from a platform, access to which is protected by an enclosure with the features specified in articles 4 and 5;
3°  from a terrace attached to the residence and laid out in such a way that the part of it opening onto the pool is protected by an enclosure having the characteristics set out in articles 4 and 5.

7. To prevent a child from climbing into the pool, any equipment connected to its operation must be installed more than one meter from the pool wall or, as the case may be, the enclosure.

The pipes connecting the appliance to the pool must be flexible and must not be installed in such a way as to facilitate climbing over the pool wall or, as the case may be, the enclosure.

Notwithstanding the first paragraph, any appliance may be located within one metre of the pool or enclosure when installed:

1°  inside an enclosure having the characteristics specified in articles 4 and 5;
2°  under a structure that prevents access to the pool from the device and that has the features specified in paragraphs 2 and 3 of the first paragraph of article 4;
3°  in a shed.
Any fixed structure or equipment that can be used to climb over the pool wall or enclosure, as the case may be, must also be installed at a distance of more than one meter from the pool wall or enclosure. This minimum distance applies to a window located less than 3 m from the ground, unless its maximum opening does not allow the passage of a spherical object more than 10 cm in diameter.

8. All installations intended to give or prevent access to the pool must be maintained in good working order.

SECTION II.1

DIVING

8.1. Any pool equipped with a diving board must be installed in compliance with BNQ standard 9461-100 "Residential pools equipped with a diving board - Minimum water envelope to prevent cervical spinal cord injuries resulting from diving from a diving board" in effect at the time of installation.

SECTION III

PERMIT

9. In order to ensure compliance with the standards set out in this by-law, a permit issued by the local municipality in whose territory the work will be carried out is required to build, install or replace a swimming pool, to install a diving board or to erect a structure giving or preventing access to a swimming pool.

A person who has obtained a permit to install a demountable pool is not required to submit a new application to reinstall a demountable pool in the same location and under the same conditions.
For the duration of the work, the person to whom the permit referred to in the first paragraph is issued must, where applicable, provide for temporary measures to control access to the pool. These measures take the place of those provided for in Division II, provided the work is completed within a reasonable time.

SECTION IV

APPLICATION

10. These regulations apply to all new installations installed on or after January 1.er July 2021. However, the second paragraph of Article 4, the fourth paragraph of Article 7 and Article 8.1 do not apply to a new installation acquired before that date, provided that such installation is installed no later than September 30, 2021.

It also applies to all installations existing prior to 1ster July 2021, with the exception of the second paragraph of article 4, the fourth paragraph of article 7 and article 8.1. Any such facility existing prior to July 1er November 2010 must comply with the applicable provisions of this by-law by September 30, 2025.
The relocation, on the same lot, of a swimming pool referred to in the second paragraph does not have the effect of making the second paragraph of article 4, the fourth paragraph of article 7 and article 8.1 applicable to the installation including this swimming pool. However, when such a pool is replaced, the existing installation must be made compliant with these provisions.

SECTION V

PENAL PROVISIONS

11. Any pool owner who contravenes a provision of the present by-law is liable to a fine of not less than 500 $ and not more than 700 $. These amounts are respectively increased to 700 $ and 1,000 $ in the event of a repeat offence.
